2 Gates – Drug and Alcohol Policy

 

1. Purpose

2 Gates is committed to maintaining a safe, healthy, and productive work environment. This policy establishes requirements for drug and alcohol use and testing in compliance with applicable federal and state regulations, including Department of Transportation (DOT) standards.


2. Scope

This policy applies to:

  • All drivers operating commercial motor vehicles (CMVs)
  • Employees performing safety-sensitive functions
  • Applicants for safety-sensitive positions

3. Prohibited Conduct

Drivers and safety-sensitive employees are strictly prohibited from:

  • Using or possessing illegal drugs at any time
  • Reporting for duty or remaining on duty under the influence of drugs or alcohol
  • Consuming alcohol within 4 hours prior to performing safety-sensitive functions
  • Having a blood alcohol concentration (BAC) of 0.04 or greater while on duty
  • Using controlled substances without a valid prescription
  • Misusing prescribed medications that impair safe driving ability
  • Refusing to submit to required drug or alcohol testing

4. Drug and Alcohol Testing

2Gates conducts testing in accordance with DOT regulations, including:

a. Pre-Employment Testing

  • All applicants must pass a drug test before performing safety-sensitive duties.

b. Random Testing

  • Employees are subject to unannounced random drug and alcohol testing throughout the year.

c. Post-Accident Testing

  • Required following certain accidents as defined by DOT regulations.

d. Reasonable Suspicion Testing

  • Conducted when a trained supervisor observes signs of drug or alcohol use.

e. Return-to-Duty and Follow-Up Testing

  • Required for employees returning to safety-sensitive duties after a violation.

5. Testing Procedures

  • All testing will follow DOT guidelines for specimen collection and chain of custody.
  • Certified laboratories and Medical Review Officers (MROs) will be used.
  • Employees have the right to request split sample testing.

6. Consequences of Violations

Any employee who violates this policy may be subject to:

  • Immediate removal from safety-sensitive duties
  • Disciplinary action, up to and including termination
  • Mandatory evaluation by a Substance Abuse Professional (SAP)
  • Completion of treatment and return-to-duty process (if applicable)

7. Prescription and Over-the-Counter Medications

  • Employees must inform their supervisor if they are taking medications that may impair performance.
  • Drivers are responsible for ensuring that any medication does not affect their ability to safely operate a CMV.

8. Employee Responsibilities

Employees must:

  • Comply with all aspects of this policy
  • Report violations or unsafe behavior
  • Cooperate fully with testing procedures
  • Notify the company of any drug- or alcohol-related convictions

9. Supervisor Responsibilities

Supervisors must:

  • Enforce this policy consistently
  • Receive training on recognizing signs of substance abuse
  • Document and act on reasonable suspicion observations

10. Confidentiality

All drug and alcohol testing records will be maintained in strict confidence and released only as required by law.


11. Policy Acknowledgment

All employees must sign an acknowledgment confirming they have received, read, and understand this policy.

You acknowledge and agreement to this policy by digital signature via employment application and by submission of your load trip sheets/inspections.
